This contest is open only to residents of Canada who have reached the age of majority in their province of residence except where prohibited by law.  Employees of Nygård International Partnership or Alberto-Culver Canada Inc. (collectively, the “Sponsors”), their representatives, agents, advertising and promotional agencies, affiliated and related companies, and members of the household of such employees are not eligible.

 
How to Enter

Contest begins January 7, 2008 12:00 a.m. (ET) and all entries must be received by March 2, 2008 11:59 p.m. (ET). You may enter by:

  • Visiting www.Nygard.com (“Contest Website”) and completing an online entry form in full and submitting as instructed.  In the event of a dispute as to who submitted an entry, the entry will be deemed submitted by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

In your entry, you will be asked to provide your first and last name, residential address, city, province, area code, phone number and your e-mail address.  All mandatory fields must be completed.  Sponsors are not responsible for late, lost, misdirected, illegible or incomplete entries, which will be deemed void.  The use of any automated equipment to participate in this contest is prohibited.


Limit: one entry per person.  Multiple entries from the same person will void all entries from that person.

By entering, you consent to the Sponsors use, should you become a winner, of your name, place of residence and photograph or other likeness, without further compensation or notice, for publicity, advertising, or informational purposes, in any media or format (including the Internet) in connection with this contest or future similar contests or product promotions and special offers.

 

By entering, you declare that you agree to and have complied with the contest rules.


All entries become the property of the Sponsors and will not be returned to entrants.  The selected entrant may be required to provide Sponsors with proof that the selected entrant is the authorized account holder of the e-mail address associated with the selected entry.

 

Prizes

The approximate total value of the prizes is $500.00.


There will be five (5) prizes awarded.   Each prize consists of a Gift Basket, filled with St. Ives products; the approximate value of each prize is $100.00.  Except as expressly warranted herein, the Prizes are provided to winners “as is” without further warranty of any kind. Prize must be accepted as awarded. NO SUBSTITUTION OF PRIZES IS PERMITTED EXCEPT BY SPONSORS IN THEIR SOLE DISCRETION.  SPONSORS RESERVE THE RIGHT TO SUBSTITUTE ANY PRIZE WITH ANOTHER PRIZE OF EQUAL OR GREATER VALUE, IF A PRIZE CANNOT BE AWARDED AS DESCRIBED FOR ANY REASON.  PRIZES ARE NON-TRANSFERABLE AND ARE NOT REDEEMABLE FOR CASH OR CREDIT, IN WHOLE OR IN PART.

 

Selection of Winners


The five (5) Winners will be drawn after the close of the contest, on March 3, 2008 in Toronto, where a random draw will be conducted for the prizes from all eligible entries received during the period of the contest.  The selected entrants for the prizes must first correctly answer a mathematical skill-testing question to be administered by phone and then sign a standard declaration/release form confirming compliance with the contest rules and acceptance of the prize as awarded.  If a winner cannot be reached within forty-eight (48) hours, or if any condition stipulated above or in these rules is not respected, participation by the person selected will be cancelled and a new draw will take place in compliance with these rules in order to allocate all prizes, and this process will continue until a participant has been selected and declared the winner.


The list of winners will be available on the contest website from the date of confirmation of the identity of the winners.  Sponsors are not responsible and shall not be held responsible for loss of prizes due to changes in mailing addresses, errors in completed entry forms or any other circumstances leading to an invalid, erroneous or incomplete mailing address or e-mail address.  Sponsors will not be liable for late, lost, misdirected or unsuccessful efforts to notify selected entrants.  Return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate winner.

 
General Terms and Conditions


Entrants agree to abide by the terms of these rules and by all decisions of the Sponsors, which are final in all matters pertaining to the contest. Contest is subject to all applicable laws.  By entering, participants release and hold harmless Sponsors, their affiliated and related companies and advertising, promotion agencies and all of their respective directors, officers, shareholders, employees, agents, successors and assigns (collectively, the “Contest Entities”) from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the contest or any prize won.  Sponsors reserve the right at their sole discretion to disqualify any individual from the contest and to ban the individual from any future contest of the Sponsors that they find or believe to be tampering with the entry process or the operation of the contest or contest Website; to be acting in violation of the rules or in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.  ANY ATTEMPT BY AN ENTRANT OR ANY OTHER PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

 
Limitations of Liability


Without limiting the release above, and for greater certainty, the Contest Entities will not be liable for: a) any incorrect or inaccurate information, whether caused by Contest Website users or by any equipment or programming associated with or utilized in the contest or by any technical or human error which may occur in the processing of entries in the contest; b) any error, omission, interruption, deletion, defect or delay in operation of the contest website or any transmission in connection with the contest; c) any communications line failure, theft, destruction or unauthorized access to, or alteration of, entries; d) any problems with, or technical malfunction of, any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, or failure of e-mail which may occur for any reason whatsoever, including technical problems or traffic congestion on the Internet or at any website or combination thereof; or e) any injury or damage to entrant’s or to any other person's computer related to or resulting from participating or downloading materials related to this contest.  If the contest is not capable of running as planned for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the Contest Entities which corrupt or affect the administration, security or proper conduct of this contest.  Sponsors reserve the right at their sole discretion subject to the approval of the Régie des Alcools, des Courses et des Jeux to, without advance notice, terminate or suspend the contest, in whole or in part, or modify it in any way.

 

 

 

Régie des Alcools, des Courses et des Jeux

 

The Régie des Alcools, des Courses et des Jeux monitors and regulates any contests open to Quebec residents.  Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des Alcools, des Courses et des Jeux for a ruling.  Any litigation respecting the awarding of a prize may be submitted to the Régie des Alcools, des Courses et des Jeux only for the purpose of helping the parties reach a settlement.


Privacy
